Client may be an individual or a legal entity, and in either case, by clicking “I Accept” or otherwise using our website, you confirm that you have read, understood, and agree to be bound by this Agreement.

2.2 Acceptance and Clickwrap Acknowledgment

Upon initiating any transaction, registration, or engagement with our Services, the User will be presented with a clickwrap agreement that confirms your express consent to these terms. Your electronic acceptance indicates that you have read and agree to all terms contained herein, including those referencing external policies that form part of this Agreement.

While we strive to maintain high standards of quality and performance, our Services are provided “as is” without any warranties as to their reliability, timeliness, or error-free operation. We expressly disclaim all warranties, whether express or implied, including but not limited to conditions of merchantability, fitness for a particular purpose, and non-infringement, subject to legal limitations.

2.9 Limitation of Liability

To the fullest extent permitted by applicable law, Webdesigner.tr shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use or inability to use our Services, even if we have been advised of the possibility of such damages. 2.10 Dispute Resolution

Initially, parties agree to attempt resolution via mediation prior to seeking other forms of dispute resolution. Should mediation fail, any unresolved disputes shall be submitted to the courts of Marmara Ereğlisi Adliyesi , subject to applicable international legal principles in the EU, UK, and Australian frameworks.

2.11 Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws applicable in the European Union, the United Kingdom, or Australia, as applicable. Any disputes arising from or in connection with this Agreement shall be exclusively resolved in the jurisdiction selected by Webdesigner.tr, unless otherwise required by mandatory legal provisions in the relevant territories.

2.12 Termination

Either party may terminate this Agreement if the other party breaches any material part of these Terms and Conditions. In the event of termination, all outstanding payment obligations shall become immediately due, and any licenses to use our digital content will immediately cease to be valid.

2.13 Severability

If any provision of this Agreement is found to be invalid or unenforceable, such provision shall be modified to the minimum extent necessary to enforce the intentions of the parties. The remaining provisions shall continue in full force and effect.

2.14 Entire Agreement

This Agreement constitutes the entire understanding between the parties with respect to the subject matter herein and supersedes all prior or contemporaneous communications, whether electronic, oral, or written.
